PLEASE CAREFULLY READ THE FOLLOWING TERMS AND CONDITIONS AS THEY CONTAIN IMPORTANT INFORMATION CONCERNING YOUR RIGHTS AND OBLIGATIONS. THESE TERMS INCLUDE VARIOUS LIMITATIONS AND EXCLUSIONS, AS WELL AS A CLAUSE THAT DETERMINES THE JURISDICTION AND AUTHORITIES ON MATTERS OF CONFLICT RESOLUTION, AS WELL AS THE APPLICABLE LEGISLATION.

BY ACCESSING, READING OR USING THE MATERIALS OR SERVICES ACCESSIBLE ON OR VIA THE "WEBSITE" OR OTHER WEBPAGES OR APPLICATIONS, THE USER DECLARES THAT HE/SHE ACKNOWLEDGES AND ACCEPTS THESE “TERMS AND CONDITIONS" AS BEING EQUIVALENT TO A SIGNED LEGALLY BINDING AND WRITTEN DOCUMENT.

The use of any website owned by House My Student of the Contents or Application, confers the status of User and implies full and unreserved acceptance, by the User, of the applicable Terms and Conditions each time the User accesses the Contents or Application.

House My Student reserves the right to modify these Terms and Conditions at any time. Any changes made to these Terms and Conditions that may affect the rights of the User will be communicated on the Website or Application. We suggest that you frequently review these Terms and Conditions, so as to be aware of their scope and of any changes that have been made. By accessing the Websites or Application owned by House My Student, following the publication of notice of such changes or updated versions, you agree to comply with the new terms. The User is aware that the access and use of the Website and/or the Contents is done under his/her sole and exclusive responsibility. Some services of the Website or the House My Student Application may be subject to specific conditions that, where appropriate, replace, complete and/or modify these Terms and Conditions. The provision of the service at the request of the User, implies the express acceptance of the Applicable specific terms and conditions.

The access, registration, browsing, use, storage and/or downloading of materials and/or use of the services of any Website and/or Content of House My Student by minors (under 18 years) is prohibited. The User, while accessing or using any Website and/or Content of House My Student declares to be at least 18 years of age.

House My Student  offers an Online Platform that connects Accommodation Owners or managers (hereinafter “Owner/s”) with Residents (as defined below), who wish to reserve such Accommodation for periods longer than one month (hereinafter, jointly, Services). These Services can be found on https://www.housemystudent.com  and other websites, applications for mobile and other devices, through which House My student offers its Services. House My student does not offer touristic Accommodation.

House my Student offers the accommodation site in good faith and as a courtesy to both students/tenant and local landlords, homeowners (Hosts). House My Student bears no responsibility whatsoever for the content of the advertising material or any errors, omissions or inaccuracies contained therein. The information provided on the website is for information purposes only and should not be construed as a representation, recommendation or endorsement made on behalf of House My Student.

The letting agreement entered into shall be between the student/tenant and the landlord homeowner only.

It is the responsibility of each student and his/her parents to check the property and satisfy themselves that they are comfortable with the accommodation arrangements and the individuals involved before signing any agreement. House my student cannot take responsibility or become involved in any disputes or letting issues between tenants and landlord/homeowner.

Inclusion in our service is at the discretion of House my student and we reserve the right to withdraw services from any individual without notice.

Please be aware that not all  properties have not been inspected by House My Student and we do not carry out Garda vetting on prospective landlords. It is the responsibility of each student and his/her parents to check the property and satisfy themselves that they are comfortable with the accommodation arrangements and the individuals involved before signing any agreement. House My student is for Students of 18 and over so no Garda vetting is necessary.

A. Use of House my student website

Please read the following terms and conditions carefully before using House my student, as these will apply to your use of our Site.

By using our Site you confirm that you accept these terms of use and that you agree to comply with them. If you do not agree to these terms of use, you must not use our Site.

B. Changes to these terms

We may revise these terms of use at any time by amending this page. Please check this page from time to time to take notice of any changes we made, as they are binding on you.

C. Alterations to our Site

We may change or update the content of our Site from time to time.

The content on our Site may be out of date at any given time and we are under no obligation to update it.

We do not guarantee that our Site, or any content on it, will be free from errors or omissions.

D. Accessing to our Site

Our Site is made available free of charge. A fee of 12.5% is only charged to the student when then have made an agreement with the host/landlord to use their premises for time allocated. 15% is charged to working professionals.

We do not guarantee that our Site, or any content on it, will always be available or be uninterrupted. Access to our Site is permitted on a temporary basis. We may suspend, withdraw or discontinue or change all or any part of our Site without notice. We will not be liable to you if for any reason our Site is unavailable at any time or for any period.

You are responsible for making all arrangements necessary for you to have access to our Site. You are also responsible for ensuring that all persons who access our Site through your internet connection are aware of these terms of use and other applicable terms and conditions and that they comply with them.

E. Your Password and Account

If you choose, or you are provided with a password or identification code, you must treat such information as confidential. You must not disclose it to any third party.

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at info@housemystudent.com

F. Uploading content to our Site

Any content you upload to our Site will be considered non-confidential and non-proprietary and we have the right to use, copy, distribute and disclose to third parties any such content for any purpose.

We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our Site constitutes a violation of their intellectual property rights, or of their right to privacy.

We will not be responsible, or liable to any third party, for the content or accuracy of any content posted by you or any other user of our Site.

We have the right to remove any posting you make on our Site.

The views expressed by other users on our Site do not represent our views or values.

G. Ownership of Intellectual Property

We are the owner or the licensee of all intellectual property rights on our Site and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may print off one copy and may download extracts, of any page(s) from our Site for your personal use and you may draw the attention of others within your organisation to content posted on our Site.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of content on our Site must always be acknowledged.

You must not use any part of the content on our Site for commercial purposes without obtaining a licence to do so from us or our licensors.

If you print off, copy or download any part of our Site in breach of these terms of use, your right to use our Site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

H. Accuracy of information and limitation of liability

We and our suppliers have taken reasonable care that the content of this Site, including the information and listings, is correct on the basis of the most current information available to it. We publish such information in good faith. As a user you acknowledge and accept that: we cannot and have not checked the accuracy of information provided by accommodation providers such as landlords, homeowners and letting agents (‘Advertisers’); this information may include errors; and while Advertisers are requested and encouraged to correct and update their information regularly and as needed, we will not be responsible for errors, omissions or misleading information in accommodation information and listings.

I. Equal Opportunities

We will not knowingly accept or place any advertisement which shows any preference, limitation or discrimination based on race, colour, religion, gender, handicap, family status, national origin or intention to make any such preference, limitation or discrimination. All premises advertised are available on an equal opportunity basis.

J. No reliance on information

The content on our Site is provided for general information only. It is not intended to amount to advice on which you should reply. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our Site.

Although we make reasonable efforts to update the information on our Site, we make no representations, warranties or guarantees, whether express or implied that the content on our Site is accurate, complete or up to date.

K. Limitation of our Liability

Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law and Irish Law.

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our Site or any content on it, whether express or implied.

We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with; use of, or inability to use, our Site,use of or reliance on any content displayed on our Site

If you are a business user, we will not be liable for; loss of profits, sales, business, business interruption, loss of anticipated savings, loss of business opportunity, goodwill or reputation, any indirect or consequential loss or damage.

If you are a consumer user, we only provide our Site for domestic and private use. You agree not to use our Site for any commercial or business purposes and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Site or to your downloading of any content on it, or on any website linked to it.

We assume no responsibility for the content of websites linked on our Site. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.

L. Data Protection

Our Privacy Policy sets out the terms on which we process any personal date we collect from you, or that you provide to us. By using our Site you consent to such processing and you warrant that all data provided by you is accurate. The Privacy Policy also sets out information about the cookies used on our Site.

M. Viruses

We do not guarantee that our Site will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and platform in order to access our Site. You should use your own virus protection software.

You must not misuse our Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Site, the server on which our Site is stored or any server, computer or database connected to our Site. You must not attack our Site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Site will cease immediately.

N. Third Party Links &­­­­ Resources In Our Site

Where our Site contains links to other sites and resources provided by third parties, these links are provided for your information only.

We have no control over the contents of those sites or resources.

O. Applicable Law

If you are a consumer, please note that these terms of use, its subject matter and its formation, are governed by English and Irish law. You and we both agree to that the courts of England and Ireland will have non-exclusive jurisdiction.

If you are a business, these terms of use, its subject matter and its formation (and any non-contractual disputes or claims) are governed by English and Irish law. We both agree to the exclusive jurisdiction of the courts of England and Ireland.

P. In the event of a student leaving before the end of their booking 

If you leave less than 1 mnth  before the original departure date you booked, please note that you will be required to pay your rent in full up until the date of your original booking. Please also inform your host as soon as possible of your new departure date, so that they can check you out under the best conditions possible.

If you leave more than 4 weeks before the original departure date you booked, a minimum of 2 weeks notice is required. (The rent will be due up to your new departure date and an additional 2 weeks compensation rental may be charged)

In the event of a Student/.Guest not satisfied with the placement: 

- The student must contact House My student  and explain the situation at hand.

- If the host shows that the student is not making an effort to fit into the house and does not follow the general rules, engages in illegal activities, is rude and/or impolite, then House My student may decide to terminate the placement with no refund of the placement fee. 

- If the host is not striving to maintain the standards as set by House My student then the student/Guest will be placed in a new host family without any administration fee.  

Removal: House My student  will remove any student who is showing dangerous, illegal, inappropriate or unsuitable behaviour.

 

DAMAGE TO THE ACCOMMODATION

The Student/guest is responsible for maintaining the Accommodation in the same condition when he/she arrived at the Accommodation. The Resident and the Owner acknowledge and accept that they are responsible for their own acts or omissions, as well as those of anyone who has been invited or granted access to the Accommodation. House My student  will not be held liable, for any event, where damage have been caused to the Accommodation, where such liability shall be resolved between Owner and Resident.

EXTRA INFORMATION.

1. KEY TERMS

“House My Student content” means all that which is provided by House My student via its Platform, Application and services, including any content authorised by a third party.

“Content” means text, graphics, images, music, software, audio, video, information and any other material published on the Platform or Application.

“Platform / Website” means any of the domains through which House My student allows the Users to use or browse the Online Platform.

”Application” means any Application available for mobile devices allowing Users to gain access to the services available through the Website.

“User” means any person who uses the Website or Application owned by House My student

“Resident” means the person requesting a reservation for the Accommodation via the Platform, Application or services and/or who is residing at an Accommodation and who is not the Owner of the same Accommodation.

“Owner” means the person or entity that has entered into an Agreement with House My student to publish an Advertisement for the Accommodation on the Platform, in order that a Resident may make a reservation for the Accommodation via the Platform. Owners may be either individuals or legal entities, or any other entity that is the owner or manager to enter into a Lease Agreement for the Accommodation on their own behalf or for a third party for a lease period exceeding one month.

“You” means the User, Resident or Owner, Student (as appropriate).

“Advertisement” means the publishing of the Accommodation by the House My student staff, by Agreement between the House My Student staff and the Owner, in order that it be made available for reservation on the Platform.

“Accommodation” means the residence, flat, house, lodging or room that the Owner publishes on the House My student Website, in order that the Resident may make an online reservation.

“Tenancy Agreement” means the Private Lease Agreement signed by the Owner (as the lessor) and by the Resident (as the lessee), to which House My student is not party.

“Move-in Date” means the date in which the Resident indicates, at the time of making the reservation, he/she will begin occupying the Accommodation.

“Move-out Date” means the date in which the Resident indicates, at the time of making the reservation, he/she will vacate the Accommodation.

“Reservation/Booking Fee” means that which is paid by the Resident to House My student when making a reservation for the Accommodation via the Platform or Application and after the reservation has been confirmed by the Owner. 

“First Payment” means that which is transferred by the Resident when making a reservation for the Accommodation via the Platform or Application and after the reservation has been confirmed by the Owner.

“Service Fee” means that previously agreed between a House My student salesperson and an Owner, which is calculated as a percentage of the Total Contract Value.

“Tax” or “Taxes” means the Value Added Tax (VAT) and any other applicable municipal, autonomous community or state tax.

2. USE OF THE PLATFORM, APPLICATION AND SERVICE

The Platform and Application are used by the Residents to make a reservation for Accommodation arrangements that are for a period longer than one month. Accommodation is published on the Platform or Application by the House My student staff upon the request and approval of the Owners, through the use of the technology required for this purpose. House My student  IS NOT AN OWNER, MANAGER OR REAL ESTATE AGENT AND House My student DOES NOT POSSESS, SELL, RESELL, FURNISH, RENT, SUBLET, MANAGE, NOR DOES IT CONTROL, THE PROPERTIES IN ANY MANNER WHATSOEVER.

House My students ’s responsibilities are limited to:

  • a) Providing the Platform, Application and services.
  • b) House My student taking a booking Fee once the Owner has accepted the Reservation and profile of the student /guest.  on arrival student pays the host the full monthly and each month thereafter for duration of stay or weekly/day what is owed. House My student will not receive any additional payments after the reservation has been confirmed by the Owner and, from that moment, the Owner is solely responsible for collecting rent payments, unless otherwise agreed between the Owner and House My student.

TERMINATION AND CLOSING OF HOUSE MY STUDENT ACCOUNTS

HOUSE MY STUDENT, at its sole discretion and without the need to substantiate the reasons, may restrict access to the Website, disable or cancel Advertisements, all without it being held liable and without the obligation to provide prior notice.

Owners may request that HOUSE MY STUDENT remove their own Advertisement for their Accommodation from the Platform, by writing to: INFO@HOUSEMYSTUDENT.COM  Please note that if the Advertisements are removed, HOUSE MY STUDENT  is not obliged to transfer the content of the Advertisements to any Owner.
